Literal Infringement

This lesson defines and applies the concept of literal infringement in patent law. It also examines the process through which the patentee establishes literal infringement.

On completion of the lesson, students will be able to:

  1. Demonstrate an understanding of how courts construe the meaning of a patent claim in the context of an infringement action.
  2. Explain the two step process courts use to determine whether the accused product or process infringes a claim.
